Actor Sean Penn facing battery, vandalism charges in L.A.

Actor and director Sean Penn was charged with misdemeanor battery and vandalism in Los Angeles on Friday.

The 49-year old Oscar-winner allegedly kicked a paparazzo in his leg and smashed his camera last Fall at a shopping mall in Brentwood. The altercation was videotaped and displayed on the celebrity news web site TMZ.com.

Penn, who won Oscars for his roles in "Mystic River" and "Milk," faces up to a year and a half in prison if convicted, according to a police source in L.A.

The volatile actor is scheduled to make his initial court appearance on March 22, 2010.

Many entertainment reporters were surprised at the news of Penn's latest legal problem since the L.A. County District Attorney's Office decided at first not to charge Penn. However, the D.A. now feels the violent act warrants prosecution, according to the police source.

This is not the first time the actor is facing charges for violent behavior. Twenty-two years ago he was incarcerated for assaulting a bit-part actor on the set of a motion picture in which Penn was starring. He served more than 30 days in a county jail cell.

Two years later, he faced a domestic assault complaint filed by his then wife pop star Madonna.
Their rocky marriage ended in 1989.

In 2006, he attacked a paparazzo who crashed his brother Chris Penn's funeral service and began photographing the mourners.

Last year, Penn and actress Robin Wright Penn, his wife, broke up then reconciled, but are now in the midst of a divorce.
